Guarantees Law
Guarantees Law is a branch of law that focuses on regulating the guarantees and securities that are established to ensure compliance with an obligation, whether payment of a debt, fulfillment of a contract or other legal obligation. Our practice in this area focuses on the following services:
- Real Guarantees: refer to the rights that are granted over a movable or immovable property as collateral for an obligation, such as a mortgage on a property. to guarantee a loan.
- Personal Guarantees: refer to third-party commitments to comply with an obligation in the event of default by the main debtor, such as a bond or guarantee.
- Movable Guarantees: refers to the delivery of movable property as collateral for a debt, such as a vehicle as collateral for a loan; specifically with regard to the Movable Guarantees Law No. 45-20.
- Mortgage Guarantees: Refers to the formalization of an obligation against real estate as a guarantee for its fulfillment.
- Trusts: refers to the transfer of ownership of an asset to a trustee to guarantee compliance with an obligation.
