Law of Real Estate and Movable Foreclosures
The Law of Real Estate and Movable Foreclosures is an area of law that is responsible for regulating legal procedures to make guarantees on movable and immovable property effective in the event of non-compliance with an obligation. Our practice in this area focuses on the following services:
- Mortgage Foreclosures: refers to the legal procedure through which a mortgagee can enforce the guarantee of a mortgage on real estate in the event of non-payment of the debt.
- Executions of Movable Guarantees: refers to the procedure to make effective a movable security, such as a vehicle or machinery, in the event of non-compliance with the guaranteed obligation; specifically with regard to the Movable Guarantees Law No. 45-20.
- Attachments: refers to the legal action by which the debtor’s assets are retained to ensure compliance with an obligation.
- Public Auction: refers to the liquidation of seized assets to satisfy a debt.
- Evictions: refers to the procedure to evict a tenant from a property due to non-payment or other cause of breach of the lease contract.
